Have Your Say on the draft Planning Agreement for provision of items of material public benefit in connection with Development Application for a Seniors Housing Development at 83 Lakewood Drive, Merimbula.


Background

In conjunction with Development Application 2022.335, notice is given for a proposed Planning Agreement under Section 7.4 (Formally Section 93F) of the Environmental Planning and Assessment Act 1979 between Bega Valley Shire Council and JFPG004 Pty Ltd as Trustee for JPFG004 Unit Trust. The Developer has offered to provide the following items of material public benefit in connection with the Development Application for a Seniors Housing development, being the construction of a 1.5 metre wide pedestrian footpath that would extend from the frontage of the development site to the car park at the western end of the Merimbula Boardwalk.

The Draft Planning Agreement and Explanatory Note relating to the development can also be inspected at Council’s administration centre in Zingel Place, Bega from 9.00am to 4.00pm, Monday to Friday, for a period of 28 days from 20 November 2023.

If you do not have access to a computer, ‘public access’ computers are available at Tura Marrang, Bega, Bermagui and Eden libraries to view this information.

Under the Government Information (Public Access) Act 2009, copies of your submission can be made publicly available. You can request that your name and address not be disclosed by writing ‘OBJECTION IN CONFIDENCE’ on your submission, however we may still be obliged to release these details. Submissions that do not contain the author’s name and address may not be considered, as we will be unable to validate their authenticity. As the development application is the subject of Court proceedings, your submission may also be provided to the Court and the Developer.

If you would like to comment on the proposal please write to us by 17 December 2023.  If you object to the proposal you need to tell us in your letter why you object to it and mail it to:

If you make a submission you are required to disclose information about any political donations or gifts. This includes all reportable political donations made to any local Councillor of Council and all gifts made to any local Councillor or employee of Council, within a period of two years before the application is made.  Forms for making disclosures are available on Council’s website or from Council’s Office.
