Tragically a high number of children drown or are seriously injured in swimming pools every year. So, it's important to ensure that all swimming pools are provided with adequate fencing or other safety barriers and children are supervised at all times.
Do you know!
A Development Consent or a Complying Development Certificate must be obtained prior to the construction or installation of most swimming pools.
When we refer to a ‘pool’ this also includes any excavation, structure or vessel including pools and spas that are:
- Capable of being filled with water to a depth greater than 30cm; and
- Used, designed, manufactured or adapted for swimming, wading paddling or any other human aquatic activity.
That the pools are to comply with the Standard at the time when the pool was built and only when the pool barrier has been altered or rebuilt the most current Standard applies.
All portable swimming pools and spas must still comply with the Swimming Pools Acts 1992 and the various safety requirements. This includes the ‘do-it-yourself’ pools sold at various department stores and secondhand pools bought online or at garage sales!
Pool users should be aware that if there is a death or injury in a pool, legal liability may fall on the person responsible for the pool at the time, even if a safety fence is installed.
