Clause 98D of the Protection of the Environment Operations (General) Amendment (Pollution Incident Response Management Plans) Regulation 2012 requires holders of environmental protection licences to make parts of their Pollution Incident Response Management Plan publicly available.

Background and Purpose

Clause 98D of the Protection of the Environment Operations (General) Amendment (Pollution Incident Response Management Plans) Regulation 2012 requires holders of environmental protection licences to make parts of their Pollution Incident Response Management Plans publicly available.

The information below is provided to meet Bega Valley Shire Council’s (BVSC’s) obligations under clause 98D of the Regulation in relation to its licensed landfills. The purpose of this document is to improve public access to information about the way pollution incidents are reported, managed and communicated to the general community.

All public enquiries should be directed to Bega Valley Shire Council on 6499 2222 or via the duty officer if outside business hours.

The following authorities shall be notified immediately in the event of an emergency or incident which has caused or threatened material harm to the environment.

Mechanisms for Providing Early Warnings (Clause 98C(i), Section 153C(a))

In the event of a notifiable incident occurring, owners or occupiers of premises in the vicinity of the licensed premises shall be advised and updated in one or more of the following ways, depending on the risks posed by the incident:

Nature of pollution incident Mechanism for warning residents
Risk to health and safety of nearby residents appreciable Door knocking, telephone and/or letterbox drops
Risk to health and safety of nearby residents not appreciable Media release and Council website
