Occupation Certificate

An Occupation certificate is issued for a development and grants approval for the use or occupation of a building.


An Occupation Certificate is required for any new building work, or change of use of a building, that is subject to development consent or a Complying Development Certificate.

This certificate is issued under the Environmental Planning and Assessment Act 1979 and verifies that the Principal Certifying Authority is satisfied the building is suitable to occupy. Occupation Certificates are not required for buildings which are exempt development or development which does not require development consent.

An Occupation Certificate is issued by the Principal Certifying Authority.  This may be Council or an Accredited Private Certifier.

How to apply for an Occupation Certificate


  • Step 1 - Create an account

    If you don't already have an account, create an account on the NSW Planning Portal

  • Step 2 - Apply using the NSW Planning Portal

    Go to the NSW Planning Portal and complete the online application for an Occupation Certificate (OC).

  • Step 3 - Upload required documentation

    Depending on the type of works or use, there will be certain documentation that you will be required to lodge with your application. Refer to the Mandatory Critical Stage Inspections document attached to your Construction Certificate (CC) or Complying Development Certificate (CDC).

  • Step 4 - Lodged for review

    Once the application is submitted through the Portal, an initial review will be carried out to check the information provided is sufficient for Council to accept.

    Where it is identified that further information is required before the application can be accepted, an officer will contact the applicant to request the further information or clarification. Once adequate information is provided, the application can be accepted.

  • Step 5 - Assessment of the application

    Once fees have been paid, the application will be registered and the applicant needs to book a building inspection. Inspections can be booked using our online inspection booking form.

    Officers will contact the applicant if further clarification is needed.
