Draft Voluntary Planning Agreement and Draft Local Infrastructure Contributions Plan 2024-2036

Council resolved on 17 April 2024 to endorse the draft Local Infrastructure Contributions Plan, draft policy Voluntary Planning Agreements and draft procedure Steps in negotiation of a Voluntary Planning Agreement for public exhibition.

Local infrastructure contributions, also known as developer contributions, are charged by councils on new developments to help fund local infrastructure like parks, community facilities, local roads, footpaths, stormwater drainage and traffic management.

The draft Local Infrastructure Contributions Plan will ensure the broader Bega Valley Shire community is not unreasonably burdened financially for local infrastructure required for new developments. It applies to residential accommodation resulting in a net increase in the number of dwellings on the site, any subdivision that creates a lot with a dwelling entitlement, mixed-use developments which include a component of residential accommodation and all other development over $100,000.

A planning agreement is a voluntary arrangement between a developer of land and council whereby the developer agrees to dedicate land free of cost, pay a monetary contribution, provide any other material public benefit, or any combination of these, to be used for or applied towards the provision of a public purpose. The draft policy Voluntary Planning Agreements and procedure Steps in negotiation of a Voluntary Planning Agreement has been updated to align with current best practice guidelines. The procedure provides an approval flow chart for the negotiation and approval of a Voluntary Planning Agreement.

A further report will be provided to council to consider the submissions prior to Council adopting the documents. The new contributions plan will apply to development applications or complying development certificate applications made on or after the date of adoption.

Submissions that do not contain the author’s name and address may not be considered as Council will be unable to validate their authenticity.
